1. Basis of Agreement

1.1 These Terms & Conditions (“Terms”) govern the agreement between Klotta (“we”, “us”, “our”) and you (“Customer”).

1.2 A contract is formed once you accept our quotation, whether online, by phone, or in writing.

1.3 Any quotation provided without an on-site inspection is an estimate only. If the access, waste type, weight, or volume differs from the information supplied, we reserve the right to revise the price accordingly.

2. Service Provision

2.1 We will carry out all services with reasonable care and skill.

2.2 Collection times provided are estimates and are not guaranteed.

2.3 You must ensure safe and unobstructed access to all waste for collection.

2.4 Any access issues not disclosed in advance (including parking restrictions, difficult access, heavy items, stairs, or working at height) may result in additional charges or cancellation of the collection.

2.5 If you are not present at the property, you must provide clear instructions and remain contactable during the collection window.

2.6 You confirm that you have full authority to request the removal and disposal of the waste.

2.7 If hazardous or prohibited waste is identified (see Section 3), we may stop work immediately. You will remain liable for the attendance fee and any waste already loaded.

2.8 Waste Transfer Notes (WTNs) will be completed where required. Additional documentation may be subject to an administration fee.

2.9 Sharp or dangerous items must be safely packaged and secured by you prior to collection and must not be placed loose in bags.

3. Waste Types & Restrictions

3.1 Accepted Waste (Standard Domestic & Business Waste)

We collect typical non-hazardous waste, including but not limited to:

  • Household waste
  • Furniture and bulky items
  • Non-hazardous electrical items (WEEE)
  • Commercial non-hazardous waste
  • Garden waste
  • Packaging, cardboard, plastics, and metals

3.2 Prohibited Waste

We do not collect hazardous or specialist waste unless agreed in writing in advance.

This includes (non-exhaustive list):

  • Asbestos or suspected asbestos
  • Chemicals, solvents, oils, fuels, resins, paint, and adhesives
  • Clinical or medical waste, sharps, or biological waste
  • Drug paraphernalia
  • Pressurised containers, gas bottles, and cylinders
  • Vehicle batteries, large batteries, or leaking batteries
  • Explosives, ammunition, or weapons
  • Contaminated waste (including human or animal waste and fluids)
  • Industrial machinery
  • Any waste requiring specialist licensing or handling

If prohibited waste is concealed, misrepresented, or undisclosed, we may refuse removal and apply additional charges.

4. Pricing & Payment

4.1 All prices are quoted in GBP.

4.2 Pricing is based on factors such as volume, estimated weight, labour required, access difficulty, and disposal category.

4.3 Attendance fees may apply to secure a booking and do not guarantee removal of a specific volume of waste.

4.4 Payment is due at the time of collection unless an approved credit account is in place.

4.5 Credit account holders are subject to agreed terms (typically 30 days). Late payments may incur interest (e.g. 8% above the Bank of England base rate) and reasonable administration fees.

4.6 Ownership of waste transfers to Klotta only once full payment has been received and all required documentation is completed.

5. Cancellations & Amendments

5.1 You may cancel your booking free of charge up to 5:00pm on the business day before the scheduled collection.

5.2 Cancellations after this time may result in loss of the attendance fee.

5.3 Consumers have a statutory 14-day cooling-off period; however, this is waived if you request that services begin within this period.

5.4 If we attempt dismantling but are unable to remove an item, we are not responsible for reassembly.

5.5 Additional labour charges may apply if loading time exceeds standard allowances due to access issues, waste presentation, or site conditions.

6. Liability

6.1 Nothing in these Terms limits liability for death or personal injury caused by our negligence, or any liability that cannot be excluded by law.

6.2 We are not liable for:

  • Indirect or consequential losses
  • Loss of profit, business, or goodwill
  • Damage not reported before our team leaves the site and confirmed in writing within 7 days

6.3 Due to the nature of waste removal, minor marks or scuffs may occur, especially in confined spaces. Any damage must be reported immediately.

7. Force Majeure

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including but not limited to severe weather, vehicle breakdowns, accidents, strikes, or emergencies.

8. Termination

We reserve the right to terminate services at any time. Termination does not affect your obligation to pay for services already provided or costs incurred.

9. Assignment

9.1 You may not assign or transfer your rights or obligations under these Terms without our written consent.

9.2 We may assign, subcontract, or transfer any part of our rights or obligations at any time.

Notices are deemed received 24 hours after email transmission or 3 business days after posting.

11. Data Protection

We process personal data solely for providing services and related communications. Data may be shared with regulatory, compliance, or credit reference bodies where required or permitted by law.

12. Governing Law

These Terms are governed by the laws of England and Wales, and both parties submit to the exclusive jurisdiction of the courts of England and Wales.
